Theatre enthusiasts don’t require police permission: Madras High Court

Staging of plays will now be hassle free for theatre enthusiasts in Tamil Nadu, as Madras High Court declared today that staging of plays does not require any sort of police permission and it also explained that some provisions of the Tamil Nadu Dramatic Performances Act, 1954 were unconstitutional.
N V Sankaran alias Gnani of a theatre group named 'Pareeksha', in its petition, sought to declare provisions of the Tamil Nadu Dramatic Performances Act, 1954 (Act No.33 of 1954) as unconstitutional and void, further adding, that whenever a play is put up in a theatre, the script of the play has to get prior clearance from the Commissioner of Police, if it is to be performed in the city of Chennai, in order to determine that there is nothing objectionable in the content of the plays.
The managers of the theatre halls also require the petitioner to get permission from the Commissioner of Police, and two copies of the script has to be submitted three weeks prior to the date of performance, of any play or drama. Vesting such discretion at the hands of the Commissioner of Police, who is neither an artist nor has the aesthetic sensibility to judge whether the play is objectionable, is clearly uncalled for, he said.
Theatre enthusiasts don’t require police permission: Madras High Court to According the petitioner, the Act was a relic of colonial rule in India which promulgated the Dramatic Performance Act 1876, to regulate the theatre scene in India.
Advocate General A Navaneethakrishnan in his counter said, that, "If an erroneous order was passed by the authority concerned, the act also provides for an appeal to the High Court, which will cure the defect, and sought to dismiss the petition." He also stated on instructions that the matter will be immediately referred to the opinion of the Tamil Nadu Iyal Isai Nataka Mandram by amending the rules.
After hearing the arguments from both sides, Justice K Chandru, in his order, said, "This court is of the opinion that the definition under Section 2(1) defining "objectionable performance" is too vague to be brought within the restriction of Article 19(2) of the Constitution.
The power conferred on the State Government under Section 3 as well as to the Police Commissioner / District Collectors under Section 4 is too wide and highly discretionary. Therefore, it cannot be held to be constitutionally valid and hence it is violates Article 14 of the Constitution

Cultural terrorism should stop: Kamal Hassan

Cultural terrorism should stop: Kamal HassanNoted actor Kamal Hassan, expressing his shock at the two-week ban ordered by the Tamil Nadu government on his film "Vishwaroopam" after objections from Muslim organisations, said Thursday he would seek a legal remedy.
In a statement Kamal Hassan said: "I have been ruthlessly used as a vehicle by small groups who seek political profile. Icon bashing is a great way to be noticed when you are not one yourself. It is happenning again and again. Any neutral and patriotic Muslim will surely feel pride on seeing my film. It was designed for that purpose."
"Now I will rely on law and logic to come to our support. This kind of cultural terrorism will have to stop," he added.
The film, which deals about the adversities of war, was majorly shot in the US and Afghanistan.
While he is touched by the support he and his film gets, Kamal added that he is appalled at how his movie is construed to be against his Muslim brothers.
"I am not only hurt by these accusations of denigrating a community but my sensibilities are truly insulted," said Kamal who has written, produced and directed the movie.
He said his statements in favour of the Muslim community has marked him as its sympathizer.
"I have always gone beyond the call of my duty as an actor to voice my opinion in favour of what was humane and civil. I have been part of an organization called Harmony India which worked for Hindu Muslim amity," he added.
On Wednesday the state government banned "Vishwaroopam" movie for two weeks with around 25 Muslim organisations objected to Kamal's movie on the ground that it portrays the community in bad light.
The Tamil and Telugu versions were slated for a Friday release, while the Hindi version, titled "Vishwaroop", is scheduled to come out Feb 1.
When Muslim organisations had objected to the movie, the 58-year-old organised a special show for them to allay their fears.
However, the organisations hardened their stance after watching the movie, alleging that the community was shown in bad light.
Earlier, the film got into trouble when Kamal had announced that he will premiere it first on DTH and then take it to the theatres.
But when distributors objected, he had to revise his plans. Now the Tamil and Telugu versions will be aired on DTH a week after theatrical release.

Ban on 'Vishwaroopam' unfair, says film fraternity

Ban on 'Vishwaroopam' unfair, says film fraternityThe Tamil Nadu government's ban on actor-filmmaker Kamal Haasan's movie "Vishwaroopam", following objections from Muslim organisations, has left industry members like Prakash Raj and Madhur Bhandarkar upset and angry.
The movie was slated for release Friday. However, it has now been stalled for 15 days in Tamil Nadu after representatives of some Muslim organisations met the state home secretary and submitted a memorandum, pointing that the movie portrays the community in a bad light.
Filmmakers and actors took to Twitter to share their reactions on the ban, and unanimously pondered over the worth of the Central Board of Film Certification (CBFC) in the country.
Prakash Raj: Ban on 'Vishwaroopam'. Not fair. This cultural terrorism should stop. We should stand for the right to express. We are with you Kamal sir.
Anubhav Sinha: Is the Tamil Nadu government saying that they do not recognise CBFC? Or they can't handle law and order? Or they subscribe to the objection? When a government needs to ride on a movie star, you should know how intellectually and politically bankrupt they are.
Siddharth: Ban on 'Vishwaroopam' is a regressive, back to the dark ages blow to Tamil cinema by the Tamil Nadu government… how do we make a change?
Madhur Bhandarkar: I am appalled by the Tamil Nadu government's decision to ban Kamal Haasan's 'Vishwaroopam'. After the film has been passed by the censor board. Not done.
Manoj Bajpayee: It is disappointing to hear that state government of Tamil Nadu banned 'Vishwaroopam' after the film is censored. That brings the importace of censor in question.
The Tamil and Telugu versions of the film will release Friday, while the Hindi version, titled "Vishwaroop" will hit the screens Feb 1.

Actor Sreenagara Kitty who has also become a producer though films like "Ball Pen' and 'Tony' for which shooting is under progress has done something that many people in the industry thought was impossible. He has brought his film's heroine Aindrita Ray and the film dance choreographer Imran Sardaria together which was the most difficult task to be handled by any film maker.
Though Imran had made several complaints against actress Aindrita Ray for being non co-operative and unprofessional, he had hinted that he would be choreographing any song in which Aindrita takes part.
sreenagara kitty
However Aindrita Ray who was upset with all the accusations of Imran had vowed not to work in films which had Imran as choreographer.   But even when the controversy had created a big cleavage in the relationship between  Aindrita and Imran,  Sreenagara Kitty had finished off all the talkie portions of the film and was finding out locations to shoot the songs.  He had also selected Imran Sardari to shoot the songs of the film.
Meanwhile  Aindrita was stuck up with dengue fever which had affected her health and the songs shooting had to be postponed.  Still Aindrita was maintaining that she would not like to work with Imran and had even intimated Kitty that she would not be comfortable  if songs are shot under Imran's direction.
However Kitty just wished Aindrita  with a get well soon message and had reiterated that  his prime concern was that the actress has to improve her health.
Meanwhile, Kitty had shot a solo song on himself in Malleshwaram Lamp works building under the choreography of Imran.
After Aindrita Ray improved her health, Kitty spoke to her  and convinced how Imran was  inevitable for the romantic song he had to shoot.  "The director Jayatheertha and Imran have scouted locations and even we have hired equipments as suggested by the duo. Since they wanted to picturise the song in style, we do not want to compromise' said Kitty. The song  was shot in M.G.,Road in  the night effect.
Imran says that as a technician he can not live in past, but look at the possibilities of present to make a bright future.  "When I choreographed the song, I had completely forgotten that I had criticised Aindrita earlier.  That is past and we can not remember these incidents always.  I am sure the song will showcase the city of Bengaluru in its finest form. I am happy both Kitty and Aindrita worked hard for this song' said Imran.
Aindrita says she has not forgotten the false allegations made by Imran, but she participated in the song because she wanted to prove that she has always been professional.  We did not exchange pleasantries, but I am sure the song has come out well.  I took the instructions from Imran's dance assistants' said Aindrita
